3 Hands Oyster Company Order Protection Terms of Service

3 Hands Oyster Company Order Protection is included on all shipped orders. This document outlines the terms and conditions of our shipment protection policy.

Protection

The following perils are eligible for reimbursement if they occur during or shortly after transit:

  • Delays
  • Damage
  • Theft
  • Lost Packages

Claim Limits, Eligibility, and Reimbursement Method

All claims are subject to review by our agents or automated systems before approval.

  • The maximum coverage per claim is $2,000.
  • Claims with a value below $100 will only be eligible for refunds to the original payment method.
  • Claims with a value above $100 will only be eligible for re-shipment.
  • Once a customer has filed a chargeback against an order, it is no longer eligible for a claim.

Claim Approval Policies

Delays

  • Orders are considered delayed if they arrive 1 day beyond the expected delivery date.
  • Proof of spoilage or loss of the product is required.
  • Claims must be filed within 7 days of the delivery date.

Damage

  • Orders that arrive damaged require photo documentation.
  • Proof of spoilage or loss of the product is required.
  • Claims must be filed within 3 days of the delivery date.

Theft

  • Customers may be required to fill out an affidavit or police report to be eligible for theft claims.
  • Customers must have courier tracking provided by 3 Hands Oyster Company proving the package was delivered successfully.
  • Claims must be filed within 3 days of the order delivery date.

Lost Packages

  • Orders are deemed lost if there is no movement on the last checkpoint from courier tracking provided by 3 Hands Oyster Company after 3 days.
  • Claims for lost shipments must be filed within 7 days of the order date.

Limitations of Liability

Damages Cap

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, 3 HANDS OYSTER COMPANY TOTAL LIABILITY FOR ALL DAMAGES ARISING OUT OF OR RELATED TO THE SERVICE OR THIS AGREEMENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY CUSTOMER UNDER THIS AGREEMENT.

Disclaimer of Indirect Damages

EXCEPT FOR (A) 3 HANDS OYSTER COMPANY OBLIGATION TO PAY ALL AMOUNTS DUE HEREUNDER; (B) ITS INDEMNIFICATION OBLIGATIONS; AND (C) ITS BREACH OF ANY INTELLECTUAL PROPERTY OR CONFIDENTIALITY OBLIGATIONS OR RESTRICTIONS HEREIN (INCLUDING ANY LIMITATIONS OR RESTRICTIONS ON USE OF THE SERVICE), IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGE ARISING OUT OF OR RELATED TO THE SERVICE OR THIS AGREEMENT, WHETHER SUCH DAMAGES ARISE IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE.

Modifications to Terms

3 Hands Oyster Company reserves the right to modify these Terms of Service at any time. We will notify customers of any significant changes by posting a notice on our website or by sending an email to the address associated with your account.

What does Order Protection Policy cover?

Our order protection policy covers you for nearly every cause of loss that can occur to your oysters during or shortly after delivery. The protection covers losses from Delays, Damage, Missing Items, Wrong Items, Theft, and Lost packages.

How soon will I be reimbursed after my claim is filed?

It depends on the claim! Each claim is carefully investigated, with some requiring a little more time than others. Some claims can be processed in as little as a few minutes, while others can take a few days.

How many days do I have to file a claim for my order?

It depends on the claim type.

  • Delays: 7 days from the delivery date
  • Lost: 7 days from the expected delivery date.
  • Wrong/Missing Items: 7 days from the delivery date
  • Damage: 3 days from the delivery date
  • Theft: 3 days from the delivery date.

I just noticed my order is delayed. Should I file a claim now?

Not yet. An order is considered delayed if it arrives one day later than the expected delivery date. However, your order must also have arrived damaged due to the delay in order to receive reimbursement. Depending on the outside temperature, your order can still arrive perfectly fine, even if it is a day late.

What is the maximum coverage per order that I am protected for?

You're covered for order values up to $2,000.

I already filed a dispute with my credit card company; will I still be reimbursed from your policy?

No. Once you have filed a chargeback against an order, it is no longer eligible for claim under our policy.
